RAY BROWSER’S TERMS OF SERVICE

PLEASE READ THESE TERMS CAREFULLY. BY REGISTERING FOR, ACCESSING, BROWSING, AND/OR OTHERWISE USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS, DO NOT ACCESS, BROWSE OR OTHERWISE USE ANY RAY BROWSER’S SERVICES.

1. Scope of application

These Terms of Service (“Terms of Service” or “Terms”) apply to the use of the web browser and other services, such as the website, maintained and provided by Ray Browser (the “Service”). The use of the Service is subject to acceptance of these Terms. To accept these Terms for itself, a person must have the legal capacity to do so.

2. Definitions

  • “Content” means any data and information available through the Services.
  • “Ray Browser” means Ray Browser Ltd., a limited liability company registered in Finland under business ID 3290420-7.
  • “Service” means the browser and other services, such as the website provided and maintained by Ray Browser.
  • “Terms of Service” means these Terms of Service.
  • “User” means a user, who has accepted these Terms of Service and who uses the Service.

3. Description of Services

THE SERVICE IS CURRENTLY IN ALPHA TESTING, WHICH MEANS THAT IT IS STILL UNDER SUBSTANTIAL DEVELOPMENT AND LIKELY CONTAINS ERRORS, BUGS OR OTHER ISSUES THAT COULD AFFECT ITS FUNCTIONALITY AND PERFORMANCE. BY USING THE SERVICE YOU ACKNOWLEDGE AND AGREE THAT THIS MAY AFFECT THE AVAILABILITY OF THE SERVICE. YOU HEREBY AGREE TO HOLD RAY BROWSER HARMLESS FOR ANY LOSS ARISING FROM OR RELATING TO THE USE OF THE SERVICE.

3.1 Availability of the Services

Ray Browser makes the Service available for the User pursuant to these Terms.

While Ray Browser attempts to make User’s access to and use of the Service safe, Ray Browser cannot and does not represent or warrant that the service is available at all times, free of viruses or other harmful components.

Ray Browser reserves the right to modify, change, add or remove portions of the Service from time to time without prior notice. Ray Browser may make additional features available through the Service, which may be subject to additional terms. The User’s use of any such features are subject to their acceptance of additional terms presented within the relevant feature or these Terms of Service.

Ray Browser may offer certain features of functionality for the purpose of testing and evaluation. Ray Browser reserves the right to fully or partially discontinue, at any time and from time to time, temporarily or permanently, any of the features without notice to the User.

Ray Browser cannot guarantee the security of any data that User discloses online. No advice or information, whether oral or obtained from Ray Browser or through the Service, will create any warranty or representation not expressly made herein. The User accepts the inherent security risks of providing information and dealing online over the internet and will not hold Ray Browser responsible for any breach of security.

3.2 Suspension of Services

Ray Browser does not guarantee uninterrupted use of the Service. The User is encouraged to notify Ray Browser about errors, bugs, or other issues arising from the use of the Services.

Ray Browser is entitled to suspend the use of the Services if it is necessary for the maintenance, repair, or development of the Service or if there are some other justified reasons for doing so.

Ray Browser may, in its sole discretion, elect to suspend or terminate access to, or use of the Services to anyone who violates these Terms.

4. Using the Service

The User is solely responsible for using the Services according to any laws, decrees and orders of the public authorities.

Ray Browser grants you a limited, free license to use The Service only on your compatible device and for personal non-commercial use only. Ray Browser and third-party software licensors expressly reserves all right, title and interest in the Service not specifically granted to the User in these Terms. There is no separate End User License Agreement (EULA).

The User may not copy, publish, adapt, redistribute, attempt to derive the source code, modify, reverse engineer, disassemble or decompile any Service in whole or in part, or create derivative works of any kind from any Service unless the Service intentionally makes such derivative works possible. The User may not modify or manipulate any digital rights management functions of the Service. The User may not bypass, modify, invalidate or circumvent any functions or safeguards of the Service or any mechanisms functionally related to the Service. The User may not separate any individual component of the Service. The User may not remove, alter, obscure or deface any trademarks or notices of the Service. The User may not share, distribute, rent, lease, sublicense, assign, transfer or sell the Service.

The User may not use the Service or any part of the Service in a way that violates the Terms or license that applies to a particular part of the Service. Any use of the Service for malicious purposes is expressly forbidden.

5. Privacy and personal data

Ray Browser complies with applicable (e.g., GDPR) privacy and personal data legislation. Ray Browser’s Privacy Policy and Cookie Policy are hereby expressly incorporated into and made an integral part of these Terms of Service. In providing the Service, Ray Browser processes personal data only in the extent described in Ray Browser’s Privacy Policy and Cookie Policy.

Please read the Privacy Policy and Cookie Policy carefully as they govern the collection, use, and disclosure of User’s personal information.

6. Intellectual property rights

Subject to these Terms and to all applicable licensing terms governing the use of the Service, Ray Browser, for itself and on behalf of its licensors, hereby reserves all intellectual property rights in the Services, except for the rights expressly granted in these Terms. Use of the Services, and any parts or elements does not grant any ownership right or intellectual property rights therein. Any commercial or promotional distribution, publishing or exploitation of Ray Browser’s license and materials is strictly prohibited unless you have received the express prior written permission from Ray Browser or the otherwise applicable rights holder.

Subject to these Terms of Use, the use of the Services grant Ray Browser the license to use, reproduce, adapt, modify, publish or distribute the User’s data created by the User for Ray Browser’s commercial, marketing or any similar purpose. The User expressly grants Ray Browser the right to use and analyze aggregate system activity data associated with use of the Services by the User for the purposes of optimizing, improving or enhancing the way the Services operate, and to create new features and functionality in connection with the Services in the sole discretion of Ray Browser.

The Service may contain links to third-party websites, services, or content. Ray Browser does not endorse or take any responsibility for the availability, accuracy, or legality of such third-party resources. The use of third-party resources is at the User’s own risk.

7. Disclaimers; No warranty

UNLESS OTHERWISE EXPRESSLY STATED BY RAY BROWSER, RAY BROWSER DOES NOT WARRANT THAT THE SERVICES AND ANY CONTENT, OR FEATURES MADE AVAILABLE IN CONJUNCTION WITH OR THROUGH THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES AND ANY CONTENT, DATA, SERVICES, OR FEATURES MADE AVAILABLE IN CONJUNCTION WITH OR THROUGH THE SERVICES OR THE SERVER THAT MAKES THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

UNLESS OTHERWISE EXPRESSLY STATED BY RAY BROWSER, RAY BROWSER DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE SERVICES, MATERIAL OR ANY LINKED SITES, IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE.

8. Limitations of liability

It is expressly stated that Ray Browser is not liable for any possible direct, indirect, or consequential damages resulting from the use of the Services.

9. Amendments

Ray Browser reserves the right, at its sole discretion, to change, modify, add, or remove portions of the Terms at any time by posting such changes on or through the Services. Please check these Terms periodically for changes. The continued use of the Services after such changes have been posted as provided above constitutes your binding acceptance of such changes. As long as the Service is at alpha test phase, all possible changes will be notified to the User via email.

10. Discrepancies

In case of any discrepancy between the Terms of Service and the Privacy Policy, they shall apply in the following order:

11. Miscellaneous

If any provision of the Terms is invalid, illegal or unenforceable in any jurisdiction, such invalidity, illegality or unenforceability shall not affect any other provision of the Terms or invalidate or render unenforceable such provision in any other jurisdiction. Upon such determination that any provision is invalid, illegal or unenforceable, the Terms shall be modified to effectuate the original intent of the original provision as closely as possible.

The User may not assign or transfer any rights and licenses granted under these Terms, without prior written (text form sufficient) consent of Ray Browser. Ray Browser may freely assign or transfer any rights and licenses granted under this Terms without restriction.

12. Dispute resolution

These Terms as well as the use of the Service shall be governed by and construed in accordance with the laws of Finland without giving effect to any choice or conflict of law provision or rule (whether of Finland or any other jurisdiction). The application of the United Nations Convention on Contracts for the International Sale of Goods shall be excluded.

Any dispute arising out of or in conjunction with these Terms shall be settled at the District Court of Helsinki as the court of first instance.

13. Validity of the Terms

These Terms of Service will enter into force on 1st of February 2024 and will be in force until further notice.
